Today, March 24, 2009 is Impunity Day in Kenya - the Human Rights Defenders Day.
It was the 24th day of March in 1996, when Daniel arap Moi’s State assassinated our dear Karimi Nduthu.
Karimi Nduthu had just finalized an investigative report into the state sponsored ethnic clashes of 1992 and 1993 which targeted targeting ethnic populations of the Gikuyu, Kisii, Luo and Luyha in Rift Valley, Nyanza, Western and Coast Provinces. During these two years Kenya witnessed the deaths of over 1,000 Kenyans and the uprooting of nearly half a million Kenyans from their homes- this Internally Displaced Persons (IDPs) phenomenon is not new after all! The victims were mainly from ethnic communities were considered sympathizers of the opposition FORD Kenya, FORD Asili and the Democratic Party and therefore were considered Madoa doa (ugly spot or blemishes) in Daniel arap Moi’s so called KANU strong holds of Rift valley and Coast Provinces. read more

You are the man as young as you are I believe you are one of the young kenyans - Kenya needs today.. Kudo's to you and keep up the good work of speaking out and making sense- I believe you have began the fight up front for kenyans to come out behind the dark curtains or doors and speak out.

yes Kumekucha and Mashada has become very disappointing where the posted stories mostly false and yes! tribal thing is still strong. By the way I'm from Western province but guess what you make sense and I don't care what tribe you come from, for us as Kenyans to look further than the norm i.e who do we want in our government- my opinion is none of the MP's in the coalition should be running our country.
Kenya is ready for a fresh start and it means a new constitution and brave and smart kenyans that can outsmart the current lot.
We all need a new beginning and I'm sure most ordinary kenyans from all tribes feel the same.
Keep up this blog - and lets post some concrete suggestions on how to help or work with our people to make the new constitution a reality- seems that the coalition is being paid mega salaries to stall the new constitution.

I wish we could completely de-link politicians from tribes. I mean you should be able to address Raila without dragging the whole Luo tribe behind him. That is what he wants you to do !!!!
I understand the reality of tribal politics in Kenya but this blog is not going to play into the hands of those who try to divide us along tribal lines.
I am particularly bothered by this statement:

1. The cut issue has been used to degrade the Luo people and therefore has no place here. Just stay away from it.
2. It is not just the Luo who should want to have Ruto charged if he is responsible for PEV or the maize scandal...it is all Kenyans.

Investors gloomy over Kenya graft fight
NAIROBI, Kenya, Mar 24 - The government has once again been put on the spot over its failure to fight graft in the country.
During a discussion at the Euromoney International Investment Conference held in Nairobi on Tuesday, only one delegate agreed that the government was making efforts to fight corruption.

isn't she the one who blocked Britain and America assisting in the Goldernberg and Anglo leasing file and to add to that MP Were's murder investigation by FBI/Scotland Yard and now add refusing them to help investigate yet another assassination of the president of Oscar foundation?
Martha Karua, CJ, Wako in my opinion should all be replaced they are no good for Kenya's future.

Politics
In the run-up to the multi-party general elections of 1992, KANU was convinced that Western and Nyanza Provinces had already fallen to FORD- Kenya and FORD- Asili waves, whereas Central and Nairobi had gone to FORD-Asili, FORD- Kenya and
Democratic Party waves and KANU was fast running out of Provinces.
Divide and Rule
It is thought that KANU wanted to secure Eastern, North Eastern Province, Coast and Rift valley provinces and then divide Nyanza’s people – the Luo and Kisii to see if the Kisii with the Kuria could vote for Moi and possibly allow Moi the 25% he required. KANU was sure it would get 25% in Western Kenya.
The violence of 1992 -1993 and 1997-1998 totally destroyed the economy. Tourism and agriculture were affected and the character of the Kenyan Republic was totally disfigured.
Citizenship and Rights, Democracy and Dignity all were trumped on the altar of political careers.
Investigations but No Punishment
The Kenya Human Rights Commission later published a report titled “Burning the vote” that detailed the political economy of ethnic clashes and how it benefited the corrupt and criminal KANU state.
The report was ignored by the Government. A subsequent Commission of Inquiry by Justice Akiwumi and a Parliamentary Investigation headed by Kennedy Kiliku, MP, which detailed the names of the persons bearing the greatest responsibility for the murder and dislocation were also never implemented.
This impunity for high ranking officials of Daniel Arap Moi’s government remains in place to this day – 13 years after Karimi Nduthu was murdered.
It looks as if the intention is to ensure that those named in the Waki Commission of Enquiry Report of October 15th 2008 as bearing the greatest responsibility for organizing, financing and
perpetrating the massive crimes committed as post election violence in 2007 and 2008, are also being shielded from punishment. They are enjoying state supported impunity.
The murders of thousands of Kenyans under the policy of extra judicial killings and those who killed GPO Oulu and Oscar Kingara are similarly enjoying state supported impunity as it becomes clear that the Kenya Police will never investigate itself or prosecute its own, even as all international investigative
offers of assistance are summarily rejected, and even United Nations Rapporteurs are abused and their statements binned. State supported impunity is the policy of the Government of Kenya.
Slaves to the Monster
Vice President Kalonzo Musyoka cautioned Kenyans to go slow on the Waki report saying that the Waki report had the potential to ruin people’s political careers.
How sad that a Christian Brother believes that human beings are not as important as political careers.
Kalonzo Musyoka was a long serving and hawkish Minister in Daniel Arap Moi’s government during the ethnic clashes and knows very well what happened….

It is clear that national debate is framed by politicians and the media, often as they feed their fantasies and frenzies.
The civil society (read the human rights types and others) and wananchi at large are idea-takers--sort of. They come in last, sweating and panting, reacting, with very low probabilities of making meaningful difference.
I generalize somewhat, but my concern lies with the mwananchi and my desire to see wanjiku and others to some extent drive our politics. Indulge my naivete.
Well, some person once said (paraphrased)the "third estate is everything but it currently is nothing, but can be something." I prefer not the path of a violent revolution and believe there are ways in which wananchi can get to directly frame national debate. I prefer not the pathway of the so-called "civil society" as their channels of accountability are frightening, often upwards and outwards to their foreign funders. Their accomplishments in Kenya's recent political history are yet to be objectively documented.
But I do think that there is another path: a people-to-people dialogue and empowerment. One that draws upon the distinct (and somewhat mundane) strengths of the Kenyan people--their local level associational lives. People cooperate in many different ways towards many different purposes (ummm let's exclude vicious crime gangs and witch-burning types) as they solve their problems. It seems to me that anyone interested in shifting the tenor of the debate, sustainably, would have to engage with the very local. Here lies an excessively manipulated, overexploited, underappreciated, self-deprecating fountain of strength.
So there are constraints, but how can this people-to-people thing (for lack of a better name) at the grassroots be organized? That, I believe, is part of our future.
